FREQUENTLY ASKED QUESTIONS

A “green card,” issued by U.S. Citizenship and Immigration Services (USCIS), provides proof of lawful permanent resident status, with authorization to live and work anywhere in the United States. Most green cards must be renewed every 10 years, but conditional green cards based on marriage or investment must be replaced after the first 2 years.

You must be planning to be a bona fide student (that is, not just using the visa as a way to get into the U.S.). And, you must pursue a full course of study (as opposed to being a part-time student). Your intended school program must lead to an objective such as a degree, diploma, or certificate.

Your student visa can be denied if you apply for it after the program start date on your I-20 or DS-2019 form. Consular officers can also deny your visa if the program start date has not passed but they have reason to believe that you will not enter the United States until after that date has passed.

The principal applicant receives five points for adaptability if they or their accompanying spouse or common-law partner, have a close relative in Canada such as a parent, grandparent, child, grandchild, spouse, common-law partner, sister, brother, uncle, aunt, nephew or niece who is a Canadian citizen or permanent resident and is physically residing in Canada.

Those individuals who are entered into the pool of candidates must be eligible for one of the immigration programs including the Federal Skilled Worker program, the Federal Skilled Trades Class, Canadian Experience Class or the Provincial Nominee Program. The Government of Canada and Canadian employers are able to select candidates from this pool and will issue them an “Invitation to Apply” for one of the above immigration programs.

The applicant need not visit Canada as part of the immigration process. However in some cases, familiarity with the Canadian landscape and particularly with the area of intended destination can impact positively on the assessment.

Applicants applying under the Investor or the Entrepreneur class are encouraged to undertake exploratory visits to Canada and participate in information sessions sponsored by the provinces. For Entrepreneur Class applicants, such efforts may relate to an indication of an applicant’s ability to meet the universal terms and conditions of admission.

Employers in the Canadian Health Care, Engineering, Financial Services sectors, Construction and Skilled Trades, Machining and Heavy Equipment Operators, Automotive and Agriculture are recruiting qualified individuals who are lawfully permitted to take up employment in Canada on a temporary or permanent basis. Many of these firms are currently advertising available positions in Canada’s leading newspapers, trade journals and or through the Internet.

To sponsor a family member as a permanent resident under family class sponsorship, the sponsor must fulfil the following conditions:

  • Be a citizen or permanent resident of Canada aged at least 18 years.
  • Reside in Canada, if they are a permanent resident. Canadian citizens can sponsor a family member even when living outside the country. However, he or she must reside in Canada when the sponsored family member becomes a permanent resident of Canada.
  • Have adequate resources to provide financial support to the sponsored person for the mandated duration.
